The rules relating to the exemptions mentioned inarticle L. 3335-4 of the Public Health Code, reproduced in article L. 313-1 of this Code, are set out in articles D. 3335-16 to D. 3335-18 of the Public Health Code, reproduced below:
“Art. D. 3335-16 of the Public Health Code.
The exemptions referred to in article L. 3335-4 are the subject of annual orders issued by the mayor of the municipality in which the public house whose temporary opening is requested will be located.
Applications for dispensation are only admissible if they are submitted by the sports federations or groups entitled to them at least three months before the date of the planned event. These requests must specify the date and nature of the events for which an exemption is sought.
However, in the case of an exceptional event, the mayor may grant an exemption in the light of the application sent at least fifteen days before the planned date of the event. ”

For each derogation requested, the application must specify the operating conditions of the public house and the desired opening hours, as well as the categories of drinks concerned.
A decision on these points is taken in the municipal authorisation order. ”

Any establishment mentioned in article D. 3335-16 which opens a public house without the mayor’s authorisation or without complying with the conditions set out in the temporary dispensation is subject to the procedures set out in articles 4 and 5 of decree no. 93-1101 of 3 September 1993 concerning the declaration of establishments in which physical and sporting activities are practised and the safety of these activities.
The operation of these temporary drinks outlets, authorised under the derogation, is subject to the obligations set out in articles L. 332-3 to L. 332-5 of the French Sports Code. “
