Article D3121-23 of the French Labour Code

An employee whose employment contract is terminated before he or she has been able to benefit from the mandatory compensatory rest to which he or she is entitled or before he or she has acquired sufficient rights to be able to take this rest shall receive a cash indemnity the amount of which corresponds to his or her acquired rights.

This indemnity is also payable to the dependents of an employee whose death occurs before he or she has been able to benefit from the mandatory time off to which he or she is entitled or before he or she has acquired sufficient rights to be able to take this time off. It is then paid to those entitled to obtain payment of the outstanding wages.

This indemnity has the status of wages.

Le salarié dont le contrat de travail prend fin avant qu’il ait pu bénéficier de la contrepartie obligatoire en repos à laquelle il a droit ou avant qu’il ait acquis des droits suffisants pour pouvoir prendre ce repos reçoit une indemnité en espèces dont le montant correspond à ses droits acquis.


Cette indemnité est également due aux ayants droit du salarié dont le décès survient avant qu’il ait pu bénéficier de la contrepartie obligatoire en repos à laquelle il avait droit ou avant qu’il ait acquis des droits suffisants pour pouvoir prendre ce repos. Elle est alors versée à ceux des ayants droit qui auraient qualité pour obtenir le paiement des salaires arriérés.


Cette indemnité a le caractère de salaire.
