Article D3154-2 of the French Labour Code

The rights saved in the time savings account may exceed the ceiling determined in article D. 3154-1 when a collective labour agreement provides for an insurance or financial guarantee scheme covering the additional sums saved. In the absence of such a collective agreement, the financial guarantee scheme is set up by the employer.

The schemes referred to in the previous paragraph must enable payment of the rights acquired by the employee and the compulsory contributions due to social security bodies or social institutions for the amount in excess of the aforementioned ceiling.

Les droits épargnés dans le compte épargne-temps peuvent excéder le plafond déterminé à l’article D. 3154-1 lorsqu’une convention ou un accord collectif de travail prévoit un dispositif d’assurance ou de garantie financière couvrant les sommes supplémentaires épargnées. En l’absence d’une telle convention ou d’un tel accord collectif, le dispositif de garantie financière est mis en place par l’employeur.

Les dispositifs mentionnés à l’alinéa précédent doivent permettre le paiement des droits acquis par le salarié et des cotisations obligatoires dues à des organismes de sécurité sociale ou à des institutions sociales pour le montant au-delà du plafond susmentionné.
