In accordance with the provisions of articles 141-2 and 142-8, if the person under investigation voluntarily evades the obligations of house arrest with electronic surveillance, the investigating judge may issue a warrant for his arrest or bringing to trial.
The investigating judge may also, under the conditions provided for in the fourth paragraph of Article 137-1, refer the matter to the juge des libertés et de la détention for the purposes of remand in custody.
Whatever the sentence of imprisonment incurred, the liberty and custody judge may issue a committal order against this person with a view to remand in custody, subject to the provisions of articles 141-3 et D. 32-21.
In the event of a breach of the obligations set out in 9° and 17° of Article 138, the provisions of Article 141-4 shall apply, as well as those of the second paragraph of Article 141-2 and those of the last paragraph of Article 394.
