When considering imposing such a measure, the investigating judge or the liberty and custody judge shall inform the person under investigation that he or she may request at any time that a doctor check that the procedure described in Article R. 622-1 or the article R. 544-7 du code pénitentiaire does not present a health risk.
Lorsqu’il envisage de prononcer une telle mesure, le juge d’instruction ou le juge des libertés et de la détention informe la personne mise en examen qu’elle peut demander à tout moment qu’un médecin vérifie que la mise en œuvre du procédé décrit à l’article R. 622-1 ou à l’article R. 544-7 du code pénitentiaire ne présente pas d’inconvénient pour sa santé.
