Article D3221-2 of the French General Code of Local Authorities

The delegation threshold set by the deliberation provided for in 18° of Article L. 3211-2 of this Code may not exceed 100 euros.

After examining the proposals sent by the public accountant relating to irrecoverable debts within the meaning of article R. 276-2 of the Book of Tax Procedures, the President of the Departmental Council declares the debt to be written off by decree.

He reports his decisions to the Departmental Council by means of a statement listing the debts written off and the reasons for the write-off.

He makes available to the Departmental Council the documents produced in support of the request for write-off submitted by the public accountant.

Le seuil de délégation fixé par la délibération prévue au 18° de l’article L. 3211-2 du présent code ne peut être supérieur à 100 euros.

Après instruction des propositions transmises par le comptable public portant sur des créances irrécouvrables au sens de l’article R. 276-2 du livre des procédures fiscales, le président du conseil départemental prononce l’admission en non-valeur par arrêté.

Il rend compte de ses décisions au conseil départemental au moyen d’un état listant les créances admises en non-valeur et les motifs ayant présidé à cette admission.

Il tient à la disposition du conseil départemental les pièces produites à l’appui de la demande d’admission en non-valeur présentée par le comptable public.
