Article D3334-3-1 of the French Labour Code

Where the rules of the collective retirement savings plan provide for employees to join by default, the company shall inform each employee in accordance with the procedures set out in the plan rules. The employee has a period of fifteen days from the date of such notification in which to expressly waive such membership.

The employee may be informed electronically, under conditions that guarantee the integrity of the data.

Lorsque le règlement du plan d’épargne pour la retraite collectif prévoit l’adhésion par défaut des salariés, l’entreprise en informe chaque salarié suivant les modalités prévues par le règlement du plan. Le salarié dispose d’un délai de quinze jours à compter de cette communication pour renoncer de manière expresse à cette adhésion.


Le salarié peut être informé par voie électronique, dans des conditions de nature à garantir l’intégrité des données.
