Article D40-2 of the French Code of Criminal Procedure

The observations, requests for action and additional observations provided for in IV and VI of Article 175 shall be sent to the investigating judge in accordance with the procedure laid down in the penultimate paragraph of l’article 81.

However, they may be made by electronic means of communication in accordance with the procedures laid down in Article D. 591 where the provisions of that Article are applicable following the protocol entered into by the heads of the court and the bar.

Les observations, les demandes d’actes et les observations complémentaires prévues par les IV et VI de l’article 175 sont adressées au juge d’instruction selon les modalités prévues par l’avant-dernier alinéa de l’article 81.

Toutefois, elles peuvent être faites par un moyen de communication électronique selon les modalités prévues par l’article D. 591 lorsque les dispositions de cet article sont applicables à la suite du protocole passé par les chefs de la juridiction et le barreau.
