Article D411-1-3 of the French Intellectual Property Code

The public information of the Institut national de la propriété industrielle relating to industrial property titles and the national register of companies may be made available to the public on request, by electronic means or on a computer medium, for re-use.

The re-use of all or part of this public information is subject to the applicant’s acceptance of a licence including an undertaking not to make any use of the personal data contrary to the provisions of Book III of the code of relations between the public and the administration. For the re-use of information from the national register of companies, the licence includes an undertaking to comply with the restrictions relating to search criteria laid down by order of the minister responsible for industrial property.

The procedures for disseminating information from the national register of companies and making it available to the public comply with the provisions relating to the communication of court decisions and accounting documents provided for in articles R. 123-154 à R. 123-154-1of the Commercial Code and the provisions concerning the declaration of information relating to the beneficial owner provided for in 1° to 3° of Article L. 561-46 and Articles R. 561-57 and R. 561-58 of the Monetary and Financial Code.

Les informations publiques de l’Institut national de la propriété industrielle relatives aux titres de propriété industrielle et au registre national des entreprises peuvent être mises à la disposition du public sur demande, par voie électronique ou sur support informatique, à des fins de réutilisation.

La réutilisation de tout ou partie de ces informations publiques est soumise à l’acceptation par le demandeur d’une licence incluant l’engagement à ne pas faire un usage des données à caractère personnel contraire aux dispositions du livre III du code des relations entre le public et l’administration. Pour la réutilisation des informations du registre national des entreprises, la licence inclut l’engagement de respecter les restrictions relatives aux critères de recherche prévues par arrêté du ministre chargé de la propriété industrielle.

Les modalités de diffusion et de mise à la disposition du public des informations du registre national des entreprises respectent les dispositions relatives à la communication des décisions de justice et des documents comptables prévues aux articles R. 123-154 à R. 123-154-1 du code de commerce et les dispositions concernant la déclaration des informations relatives au bénéficiaire effectif prévues aux 1° à 3° de l’article L. 561-46 et aux articles R. 561-57 et R. 561-58 du code monétaire et financier.
