Article D4131-3 of the French Public Health Code

The Conseil départemental de l’ordre may only grant authorisation if the postgraduate student concerned, including those placed on leave of absence, has attained the level of study set out in Appendix 41-1, offers the necessary guarantees of good character and does not have any infirmity or medical condition incompatible with the practice of the profession. The departmental council may request a copy of bulletin no. 2 of the applicant’s criminal record. The existence of an infirmity or pathological condition is established, where applicable, under the conditions set out in article R. 4124-3.

Reasons must be given for any refusal of authorisation by the Conseil départemental de l’ordre.

Le conseil départemental de l’ordre ne peut délivrer l’autorisation que si l’étudiant de troisième cycle concerné, y compris lorsqu’il est mis en disponibilité a atteint le niveau d’études fixé à l’annexe 41-1, offre les garanties nécessaires de moralité et ne présente pas d’infirmité ou d’état pathologique incompatibles avec l’exercice de la profession. Le conseil départemental peut demander consultation du bulletin n° 2 du casier judiciaire de l’intéressé. L’existence d’une infirmité ou d’un état pathologique est constatée, le cas échéant, dans les conditions fixées à l’article R. 4124-3.

Le refus d’autorisation du conseil départemental de l’ordre est motivé.
