Article D4163-28 of the French Labour Code

The employer shall send by any means to the local management body mentioned in the second paragraph of article R. 4163-15 a copy of the amendment to the employment contract as well as the information required for the reimbursement of the additional remuneration and the statutory and contractual social security contributions relating to this additional remuneration.

The list of items and the procedures for sending them are determined by order of the ministers responsible for social affairs and labour.

Once these elements have been sent to the body, the latter reimburses the employer for the additional remuneration and the statutory and contractual social contributions relating to this additional remuneration, paid by the employer in respect of the days mentioned in the second paragraph of article D. 4163-26.

L’employeur transmet par tout moyen à l’organisme gestionnaire au niveau local mentionné au deuxième alinéa de l’article R. 4163-15 une copie de l’avenant au contrat de travail ainsi que les éléments nécessaires au remboursement du complément de rémunération et des cotisations et contributions sociales légales et conventionnelles afférentes à ce complément.

La liste des éléments ainsi que leurs modalités de transmission sont déterminées par arrêté des ministres chargés des affaires sociales et du travail.

Une fois ces éléments transmis à l’organisme, celui-ci procède au remboursement à l’employeur du complément de rémunération et des cotisations et contributions sociales légales et conventionnelles afférentes à ce complément, versés par l’employeur au titre des jours mentionnés au deuxième alinéa de l’article D. 4163-26.
