Article D4233-3 of the French Public Health Code

In the event of a vacancy, the seat of a full member is filled by the alternate member. A vacancy is established in particular when the full members cease to hold office or when they no longer fulfil the conditions required to be eligible for election to the Association Council.

If one or more vacant full member seats cannot be filled, the competent council may hold a by-election within six months of the vacancy occurring. For the Regional Councils of Section A, the timetable for these elections is coordinated by the Central Council of the same section.

The members then elected remain in office until the date on which their term of office would have expired.

En cas de vacance, le siège d’un titulaire est pourvu par l’élu suppléant. La vacance est notamment constatée lorsque les membres titulaires cessent leurs fonctions ou lorsqu’ils ne remplissent plus les conditions exigées pour être éligibles au conseil de l’ordre.

Lorsqu’un ou plusieurs sièges de titulaire devenus vacants ne peuvent être ainsi pourvus, le conseil compétent peut procéder à une élection partielle dans les six mois à compter de la vacance de poste. Pour les conseils régionaux de la section A, le calendrier de ces élections est coordonné par le conseil central de la même section.


Les membres alors élus restent en fonction jusqu’à la date à laquelle aurait expiré le mandat de ces derniers.
