Article D43-5 of the French Code of Criminal Procedure

In accordance with articles 41-4,41-6,99,706-153 et 778, the president of the investigating chamber has sole jurisdiction to rule on applications or appeals or disputes relating to:

-to the restitution of objects placed under court supervision;

-to the seizure of intangible property or rights;

-to applications for the rectification of civil status.

The author of the application or appeal may, however, specify in his application or appeal that he is referring the matter to the Investigating Chamber in its collegiate formation.

Failing this, the President may decide, in view of the complexity of the case, that it be examined by the Chamber as a panel.

Conformément aux articles 41-4,41-6,99,706-153 et 778, le président de la chambre de l’instruction est compétent pour statuer seul sur les demandes ou les recours ou contentieux relatifs :


-à la restitution d’objets placés sous-main de justice ;


-à la saisie de biens ou droits incorporels ;


-à des demandes de rectification de l’état civil.


L’auteur de la demande ou du recours peut toutefois préciser dans sa demande ou son recours qu’il saisit la chambre de l’instruction dans sa formation collégiale.


A défaut, le président peut décider, au regard de complexité du dossier, que celui-ci soit examiné par la chambre dans sa composition collégiale.
