Article D44-2 of the French Code of Criminal Procedure

The public prosecutor, after gathering the observations of the investigating judge(s) and, where applicable, the juvenile court judge(s), as well as those of the president(s) of the criminal division(s), draws up, every two years, a performance appraisal proposal for the criminal investigation police officers assigned to a department or unit based within the jurisdiction of the court, which he forwards to the public prosecutor at the court of appeal.

The performance appraisal is drawn up by the public prosecutor, after consultation, where appropriate, with the other public prosecutors concerned within his jurisdiction, the presidents of the investigating division, the juvenile division, the criminal appeals division and the assize courts. Where the department or unit to which the judicial police officer is assigned exceeds the jurisdiction of the court of appeal, or where the judicial police officer has been assigned for less than one year within the jurisdiction of the court of appeal, the public prosecutor may also seek the opinion of the other public prosecutors concerned.

Le procureur de la République, après avoir recueilli les observations du ou des juges d’instruction et, le cas échéant, des juges des enfants ainsi que celles du ou des présidents de chambres correctionnelles, établit, tous les deux ans, une proposition de notation des officiers de police judiciaire affectés dans un service ou une unité ayant son siège dans le ressort du tribunal, qu’il transmet au procureur général près la cour d’appel.


La notation est établie par le procureur général, après consultation, le cas échéant, des autres procureurs de la République concernés de son ressort, des présidents de la chambre de l’instruction, de la chambre des mineurs, de la chambre des appels correctionnels et des cours d’assises. Lorsque le service ou l’unité dans lequel l’officier de police judiciaire est affecté excède le ressort de la cour d’appel, ou lorsque l’officier de police judiciaire est affecté depuis moins d’un an dans le ressort de la cour d’appel, le procureur général peut également recueillir l’avis des autres procureurs généraux concernés.
