Article D45-11 of the French Code of Criminal Procedure

The accounting officer of the Directorate General of Public Finance sends the interested party, for each fine, an extract from the enforcement order concerning him in the form of a notice inviting him to pay the amount of the increased fixed fine.

This notice contains the information provided for in 1° of article D. 45-5 and indicates the time limit and procedures for the complaint provided for in the second and third paragraphs of Article 495-19. In accordance with the provisions of Article 707-2 and 5° of Article R. 55, it states that in the event of voluntary payment of the increased fixed fine within one month of the date it is sent, the amount of the sums due will be reduced by 20%.

Appended to this notice is a claim form in accordance with the first paragraph of article 495-20.

Le comptable de la direction générale des finances publiques adresse à l’intéressé, pour chaque amende, un extrait du titre exécutoire le concernant sous forme d’avis l’invitant à s’acquitter du montant de l’amende forfaitaire majorée.

Cet avis contient les mentions prévues par le 1° de l’article D. 45-5 et indique le délai et les modalités de la réclamation prévue par les deuxième et troisième alinéas de l’article 495-19. Conformément aux dispositions de l’article 707-2 et du 5° de l’article R. 55, il indique qu’en cas de paiement volontaire de l’amende forfaitaire majorée dans le délai d’un mois à compter de sa date d’envoi, le montant des sommes dues sera diminué de 20 %.

Est joint à cet avis un formulaire de réclamation conformément au premier alinéa de l’article 495-20.
