Article D45-2-12 of the French Code of Criminal Procedure

When the request from the accused provided for in article 495-15 requesting the application of the procedure for appearing in court on prior recognition of guilt is sent to the public prosecutor more than three months before the date of the hearing set before the criminal court, by registered letter with acknowledgement of receipt, by a secure means of telecommunication in accordance with 21° of Article D. 591 or by declaration to the Public Prosecutor’s office against receipt, this magistrate will inform the applicant by any means if he decides not to use this procedure.

Failure to provide this information does not, however, constitute grounds for nullity of the referral to the criminal court.

Lorsque la demande du prévenu prévue par l’article 495-15 tendant à l’application de la procédure de comparution sur reconnaissance préalable de culpabilité est adressée au procureur de la République plus de trois mois avant la date de l’audience fixée devant le tribunal correctionnel, par lettre recommandée avec accusé de réception, par un moyen de télécommunication sécurisé conformément au 21° de l’article D. 591 ou par déclaration au secrétariat du procureur de la République contre récépissé, ce magistrat informe par tout moyen le demandeur s’il décide de ne pas mettre en œuvre cette procédure.

Le défaut d’information ne constitue cependant pas une cause de nullité de la saisine du tribunal correctionnel.
