Article D45-2-4 of the French Code of Criminal Procedure

The period between the date on which the person is informed of the date and time of his incarceration, at the end of the hearing or subsequently, and the date on which he is to be incarcerated may not exceed four months. As far as possible, the date of incarceration is determined by taking into account the sentenced person’s personal situation and, if applicable, the occupancy rate of the prison and its foreseeable evolution.

Custody may not begin before the sentence becomes enforceable, except where the deferred committal order is subject to provisional enforcement pursuant to IV of Article 464-2.

Le délai entre la date à laquelle la personne est informée de la date et de l’horaire de son incarcération, à l’issue de l’audience ou ultérieurement, et la date à laquelle elle doit être incarcérée ne peut excéder quatre mois. Dans la mesure du possible, la date d’incarcération est déterminée en tenant compte de la situation personnelle du condamné et, s’il y a lieu, du taux d’occupation de l’établissement pénitentiaire et de son évolution prévisible.


L’incarcération ne peut débuter avant que la condamnation ne devienne exécutoire, sauf lorsque le mandat de dépôt à effet différé est assorti de l’exécution provisoire en application du IV de l’article 464-2.
