Article D47-1-15 of the French Code of Criminal Procedure

Where the issuing authority has indicated in the European Investigation Decision that, because of procedural deadlines, the seriousness of the infringement or other particularly urgent circumstances, a shorter period than those provided for in Articles 694-35 and 694-37 is necessary, or if the issuing authority has indicated in the EIO that the investigative measure must be executed by a specific date, the magistrate hearing the case shall take this requirement into account as best he or she can.

If it is not possible, in a specific case, to meet that deadline, the magistrate hearing the case shall inform the issuing authority and the deadline shall be extended in accordance with the provisions of the second paragraph of Article 694-35 and the first paragraph of Article 694-37.

Lorsque l’autorité d’émission a indiqué dans la décision d’enquête européenne qu’en raison de délais de procédure, de la gravité de l’infraction ou d’autres circonstances particulièrement urgentes, un délai plus court que ceux prévus par les articles 694-35 et 694-37 est nécessaire, ou si l’autorité d’émission a indiqué dans la décision d’enquête européenne que la mesure d’enquête doit être exécutée à une date spécifique, le magistrat saisi tient compte au mieux de cette exigence.


S’il n’est pas possible, dans un cas spécifique, de respecter ce délai, le magistrat saisi en informe l’autorité d’émission et le délai est prorogé conformément aux dispositions du deuxième alinéa de l’article 694-35 et du premier alinéa de l’article 694-37.
