Article D47-1-8 of the French Code of Criminal Procedure

For the application of Article 694-28, where more than one Member State is able to provide the full necessary technical assistance for the same interception of telecommunications, the European Investigation Order shall be addressed by priority to the Member State on whose territory the target of the interception is or will be located.

The magistrate who has issued a European Investigation Order for the interception of telecommunications shall determine, by mutual agreement with the executing authority, whether the interception is carried out by transmitting the telecommunications immediately or after the operations have been completed.

He may also request a transcription, decoding or decryption of the recording, subject to the agreement of the executing authority.

Pour l’application de l’article 694-28, lorsque plus d’un Etat membre est en mesure de fournir l’assistance technique nécessaire complète pour la même interception de télécommunications, la décision d’enquête européenne est adressée par priorité à l’Etat membre sur le territoire duquel se trouve ou se trouvera la cible de l’interception.

Le magistrat ayant émis une décision d’enquête européenne tendant à l’interception de télécommunications détermine, d’un commun accord avec l’autorité d’exécution, si l’interception est réalisée en transmettant les télécommunications immédiatement ou à l’issue des opérations.

Il peut également demander une transcription, un décodage ou un déchiffrement de l’enregistrement, sous réserve de l’accord de l’autorité d’exécution.
