Article D47-10 of the French Code of Criminal Procedure

For the application of the provisions of Article 706-49 relating to informing the children’s judge in the event of the opening of educational assistance proceedings, must be referred to the magistrate of the public prosecutor’s office specialising in juvenile matters.

The public prosecutor or investigating judge informs the children’s judge hearing the educational assistance proceedings, throughout the criminal proceedings, of decisions that may affect relations between the parents and their children. The investigating judge may seek the opinion of the juvenile court judge before taking these decisions. This opinion is then placed in the proceedings file.

The children’s judge is informed of the outcome of criminal investigations, in particular in the event of the case being dismissed, an alternative to prosecution, the initiation of public proceedings, a settlement order or a judgment.

Pour l’application des dispositions de l’article 706-49 relatives à l’information du juge des enfants en cas d’ouverture d’une procédure d’assistance éducative, doit être saisi le magistrat du parquet spécialisé en matière de mineurs.

Le procureur de la République ou le juge d’instruction informe le juge des enfants saisi de la procédure d’assistance éducative, tout au long de la procédure pénale, des décisions pouvant avoir des incidences sur les relations entre les parents et leurs enfants. Il peut solliciter l’avis du juge des enfants avant de prendre ces décisions. Cet avis est alors versé au dossier de la procédure.

Le juge des enfants est avisé des suites données aux investigations pénales, notamment en cas de classement sans suite, de procédure alternative aux poursuites, de mise en mouvement de l’action publique, d’ordonnance de règlement ou de jugement.
