The provisions of articles 706-113 to 706-117 and the articles of this title are applicable to the criminal proceedings referred to in these articles only where the evidence gathered in the course of these proceedings shows that the person is the subject of a legal protection measure under the conditions set out in Title XI of Book I of the Civil Code.
If the elements of the proceedings reveal a doubt as to the existence of a legal protection measure, the public prosecutor, investigating judge or trial court shall carry out the necessary checks or have them carried out.
If the investigating judge or trial court only becomes aware of the existence of this measure after the prosecution has been initiated, these provisions only apply from that date. The same applies if the legal protection measure is ordered in the course of criminal proceedings.
