Article D47-21 of the French Code of Criminal Procedure

The medical expertise provided for by the purpose of Article 706-115 is to determine whether or not, at the time of the offence, the person concerned was suffering from a mental or neuropsychological disorder that had abolished or impaired his discernment or had abolished or impaired the control of his acts, in order to enable the court hearing the case to apply the provisions of Article 122-1 of the Penal Code.

When an investigation is opened, and particularly in criminal cases, this is the psychiatric expertise ordered pursuant to the eighth paragraph of l’article 81.

This expert opinion may be ordered at the investigation stage by the public prosecutor.

L’expertise médicale prévue par l’article 706-115 a pour objet de déterminer si l’intéressé était ou non atteint au moment des faits d’un trouble psychique ou neuropsychique ayant aboli ou altéré son discernement ou ayant aboli ou entravé le contrôle de ses actes, afin de permettre à la juridiction saisie d’appliquer les dispositions de l’article 122-1 du code pénal.

Lorsqu’une information est ouverte, et notamment en matière criminelle, il s’agit de l’expertise psychiatrique ordonnée en application du huitième alinéa de l’article 81.

Cette expertise peut être ordonnée dès le stade de l’enquête par le procureur de la République.
