Article D47-36 of the French Code of Criminal Procedure

The sentence enforcement judge of the jurisdiction in which the person subject to an obligation of care under article 706-136-1 at his habitual residence, assisted by the prison integration and probation service, and where appropriate with the help of organisations authorised for this purpose, monitors compliance with this obligation.

In the event of non-compliance with the obligation, the sentence enforcement judge will inform the public prosecutor, who will decide whether to prosecute the person concerned on the basis of Article 706-139.

Article D47-36

Le juge de l’application des peines du ressort dans lequel la personne soumise à une obligation de soins dans le cadre de l’article 706-136-1 a sa résidence habituelle, assisté du service pénitentiaire d’insertion et de probation, et le cas échéant avec le concours des organismes habilités à cet effet, contrôle le respect de cette obligation.

En cas de non-respect de l’obligation, le juge de l’application des peines en informe le ministère public qui décidera de l’opportunité de poursuivre la personne concernée sur le fondement de l’article 706-139.
