Article D47-37-4 of the French Code of Criminal Procedure

When the Assize Court is seised pursuant to the provisions of the second paragraph of Article 706-120, it shall, in accordance with the provisions of that paragraph, only rule in camera on the application of Article 122-1 of the Criminal Code.

The experts who have examined the person, and in particular those who have given differing opinions, must be heard by the assize court, if necessary by means of telecommunication.

The provisions of paragraphs five to ten of Article 706-122 then apply.

Jurors may also ask questions through the chairman.

Lorsque la cour d’assises est saisie en application des dispositions du deuxième alinéa de l’article 706-120, elle ne statue, conformément aux dispositions de cet alinéa, que pour se prononcer à huis clos sur l’application de l’article 122-1 du code pénal.


Les experts ayant examiné la personne, et notamment ceux ayant rendu des avis divergents, doivent être entendus par la cour d’assises, le cas échéant par un moyen de télécommunication.


Les dispositions des alinéas cinq à dix de l’article 706-122 sont alors applicables.


Les jurés peuvent également poser des questions par l’intermédiaire du président.
