Article D48-18 of the French Code of Criminal Procedure

Under the provisions of the fifth paragraph of Article 707-1, the public prosecutor shall pursue the enforcement of financial penalties imposed by the competent authorities of the Member States of the European Union.

Enforcement in France of such pecuniary penalties shall be governed by French law in the same way as criminal fines imposed by French criminal courts, subject to the provisions of paragraph 2 of this section.

The Public Prosecutor shall classify the acts which gave rise to the financial penalty under French law and shall determine the applicable limitation period in accordance with that classification. The limitation period runs, in France, from receipt of the certificate concerning the financial penalty.

En application des dispositions du cinquième alinéa de l’article 707-1, le procureur de la République poursuit l’exécution des sanctions pécuniaires prononcées par les autorités compétentes des Etats membres de l’Union européenne.

L’exécution en France de ces sanctions pécuniaires est régie par la loi française de la même manière que les amendes pénales prononcées par les juridictions répressives françaises, sous réserve des dispositions du paragraphe 2 de la présente section.

Le procureur de la République qualifie les faits ayant donné lieu à la sanction pécuniaire en application de la loi française et détermine le délai de prescription applicable en fonction de cette qualification. La prescription court, en France, à compter de la réception du certificat concernant la sanction pécuniaire.
