Article D5125-33-6-1 of the French Public Health Code

The conditions under which dispensing pharmacists may supply medicinal products for certain pathologies pursuant to 10° of Article L. 5125-1-1 A are determined in cooperation protocols drawn up under the conditions provided for in Articles R. 4011-1, D. 4011-3 and D. 4011-4.

The conditions for the prior training of pharmacists mentioned inArticle 30 of Law 2019-774 of 24 July 2019 on the organisation and transformation of the healthcare system, required for the application of 10° of Article L. 5125-1-1 A, are determined in the protocols mentioned in the first paragraph, after consultation with the relevant national professional councils and an opinion from the Haute Autorité de santé, under the conditions provided for in 3° of Article R. 4011-1.

The attending doctor is informed by the dispensing pharmacist of the dispensing of medicinal products to the patient in accordance with the procedures defined in 5° of article R. 4011-1 and in compliance with the time limits defined by each protocol.

Les conditions dans lesquelles les pharmaciens d’officine peuvent délivrer des médicaments pour certaines pathologies en application du 10° de l’article L. 5125-1-1 A sont déterminées dans des protocoles de coopération établis dans les conditions prévues aux articles R. 4011-1, D. 4011-3 et D. 4011-4.

Les conditions de formation préalable des pharmaciens mentionnée à l’article 30 de la loi n° 2019-774 du 24 juillet 2019 relative à l’organisation et à la transformation du système de santé, requise pour l’application du 10° de l’article L. 5125-1-1 A, sont déterminées dans les protocoles mentionnés au premier alinéa, après concertation avec les conseils nationaux professionnels concernés et avis de la Haute Autorité de santé, dans les conditions prévues au 3° de l’article R. 4011-1.

Le médecin traitant est informé par le pharmacien d’officine de la délivrance de médicaments au patient selon les modalités définies au 5° de l’article R. 4011-1 et dans le respect des délais définis par chaque protocole.
