The number of people benefiting from the employment obligation mentioned in Article L. 5212-13 takes into account all the workers mentioned in Article L. 5212-13, regardless of the duration and nature of their contract, including trainees, people on work experience placements and people made available by temporary work agencies or employer groups.
In the case of temporary employment agencies, groups of employers and wage portage agencies, employees who are ported or made available are not included in the number of people covered by the employment obligation.
The number of people covered by the employment obligation is calculated, subject to the reservations set out in the previous paragraphs, in accordance with the procedures set out inArticle L. 130-1 of the Social Security Code.
The number of beneficiaries of the employment obligation aged at least 50 taken into account in the calculation of the total number of beneficiaries of the employment obligation is equal to the product of the number of beneficiaries of the employment obligation aged at least 50 multiplied by 1.5. For the purposes of this calculation, beneficiaries who reach the age of 50 during the calendar year are taken into account.
A beneficiary of the employment obligation may not be taken into account several times in the calculation on the grounds that he or she falls into several categories of beneficiaries mentioned in article L. 5212-13.
