Article D528 of the French Code of Criminal Procedure

Any judgment or ruling ordering conditional release shall state the reasons on which it is based in accordance with the provisions of articles 712-4, 712-13 and 729, as well as those of this article.

It refers to the minutes of the adversarial hearing in which the meaning of the public prosecutor’s submissions is mentioned.

It specifies the guarantees of representation and resocialisation of the person concerning in particular their residence or domicile and the origin, nature and extent of the income from which they may benefit.

It mentions all the measures and conditions imposed on the sentenced person, whether these are mandatory measures and conditions or special conditions.

The practical arrangements for carrying out these measures and conditions may be specified at a later date by an instruction sent by the sentence enforcement judge to the service responsible for monitoring the sentenced person.

Tout jugement ou arrêt ordonnant une libération conditionnelle est motivé conformément aux dispositions des articles 712-4, 712-13 et 729, ainsi que de celles du présent article.

Il vise le procès-verbal de débat contradictoire dans lequel est mentionné le sens des réquisitions du ministère public.

Il précise les garanties de représentation et de resocialisation de la personne concernant notamment sa résidence ou son domicile et l’origine, la nature et l’importance des revenus dont elle pourra bénéficier.

Il mentionne l’ensemble des mesures et conditions imposées au condamné, qu’il s’agisse des mesures et conditions obligatoires ou des conditions particulières.

Les modalités pratiques d’exécution de ces mesures et conditions peuvent être précisées ultérieurement par une instruction adressée par le juge de l’application des peines au service chargé de suivre le condamné.
