Article D6132-9-3 of the French Public Health Code

I.-The grouping’s medical committee includes, with voting rights :

1° The chairmen of the medical committees of the establishments involved in the grouping ;

2° The heads of the inter-institutional clinical and medico-technical activity centres, and the coordinators of the inter-hospital medical federations set up between all or some of the institutions involved in the grouping;

3° The doctor in charge of the regional medical information department;

4° Members representing medical, odontological, pharmaceutical and midwifery staff, appointed by each establishment’s medical committee from among its members and, for medico-social establishments and services that are party to the grouping, in accordance with the procedures defined by the constituent agreement.

The term of office for the members mentioned in 4° is four years.

II – It also includes, in an advisory capacity:

1° The chairman of the strategic committee and the directors of the establishments belonging to the consortium or their representative ;

2° The chairman of the nursing, re-education and medico-technical care commission of the regional hospital grouping;

3° The directors of the medical training and research units or the chairman of the medical education coordination committee and, where appropriate, the director of the pharmacy training and research unit and the director of the odontology training and research unit, if a university hospital centre is a member of the group;

4° A representative of the healthcare risk management coordinators mentioned in article R. 6111-4, appointed by the director of the support establishment;

5° A medical professional representing, where applicable, the regional psychiatric communities, appointed by them.

The constitutive agreement may provide for the presence, in an advisory capacity, of other persons exercising functions in the establishments belonging to the grouping, in a proportion which may not exceed ten percent of the total number of members of the commission.

III -Where an army hospital is associated with a regional hospital grouping, the grouping medical committee will include staff with equivalent duties or representatives of the same staff appointed to bodies equivalent to those mentioned in I and II for the establishments involved.

IV – In consultation with the president of the strategic committee, the grouping’s medical commission may appoint up to five invited guests representing external partners cooperating with the grouping or with the participating establishments in the implementation of public health initiatives in the territory. These guests may be permanent members. They may attend meetings of the Group Medical Commission in an advisory capacity.

I.-La commission médicale de groupement comprend, avec voix délibérative :

1° Les présidents des commissions médicales d’établissement des établissements parties au groupement ;

2° Les chefs de pôle d’activité clinique et médico-technique inter-établissements, et les coordonnateurs des fédérations médicales interhospitalières mises en place entre tout ou partie des établissements parties au groupement ;

3° Le médecin responsable du département de l’information médicale de territoire ;

4° Des membres représentant les personnels médicaux, odontologiques, pharmaceutiques et maïeutiques, désignés par chaque commission médicale d’établissement en son sein et, pour les établissements et services médico-sociaux parties au groupement, selon des modalités définies par la convention constitutive.

La durée du mandat des membres mentionnés au 4° est de quatre ans.

II.-Elle comprend également, avec voix consultative :

1° Le président du comité stratégique et les directeurs des établissements parties au groupement ou leur représentant ;

2° Le président de la commission des soins infirmiers, de rééducation et médico-techniques du groupement hospitalier de territoire ;

3° Les directeurs d’unité de formation et de recherche de médecine ou le président du comité de coordination de l’enseignement médical et, le cas échéant, le directeur d’unité de formation et de recherche de pharmacie et le directeur d’unité de formation et de recherche d’odontologie, si un centre hospitalier universitaire est partie au groupement ;

4° Un représentant des coordonnateurs de la gestion des risques associés aux soins mentionnés à l’article R. 6111-4, désigné par le directeur de l’établissement support ;

5° Un professionnel médical représentant, le cas échéant, les communautés psychiatriques de territoire, désigné par elles.

La convention constitutive peut prévoir la présence, avec voix consultative, d’autres personnes exerçant des fonctions dans les établissements parties au groupement, dans une proportion qui ne peut dépasser dix pour cent du nombre total des membres de la commission.

III.-Lorsqu’un hôpital des armées est associé au groupement hospitalier de territoire, la commission médicale de groupement comprend les personnels occupant des fonctions équivalentes ou des représentants des mêmes personnels désignés au sein des instances équivalentes à celles mentionnées aux I et II pour les établissements parties.

IV.-La commission médicale de groupement peut désigner, en concertation avec le président du comité stratégique, au plus cinq invités représentant des partenaires extérieurs coopérant avec le groupement ou avec les établissements parties dans la mise en œuvre d’actions de santé publique sur le territoire. Ces invités peuvent être permanents. Ils peuvent assister avec voix consultative aux séances de la commission médicale de groupement.
