Article D6143-37-1 of the French Public Health Code

The chairman of the hospital medical committee, who is vice-chairman of the Executive Board, works with the director to coordinate the development and implementation of the hospital’s medical project, in accordance with the multi-annual contract of objectives and resources and with the shared medical project if the hospital is part of a regional hospital grouping. It monitors implementation and draws up an annual report.

The medical project is drawn up for a period of five years. It may be amended by means of a rider. It defines the hospital’s medical strategy and specifies the measures to be taken in application of the provisions of the multi-year contract mentioned in articles L. 6114-1 and L. 6114-2. It includes in particular:

1° The medical objectives in line with the regional or inter-regional health plan and the content of the care offered ;

2° The establishment’s objectives in terms of improving the quality and safety of care;

3° Where appropriate, objectives in terms of research and innovative approaches;

4° The organisation of medical resources;

5° A specific appendix specifying the links between the various areas of activity to ensure a coherent patient care pathway;

6° A section relating to the palliative activity of departments or functional units, identifying the departments in the establishment where palliative care is provided.

Le président de la commission médicale d’établissement, vice-président du directoire, coordonne, en lien avec le directeur, l’élaboration et la mise en œuvre du projet médical de l’établissement, en conformité avec le contrat pluriannuel d’objectifs et de moyens et avec le projet médical partagé si l’établissement est partie à un groupement hospitalier de territoire. Il en assure le suivi de la mise œuvre et en dresse le bilan annuel.

Le projet médical est élaboré pour une période de cinq ans. Il peut être modifié par voie d’avenant. Il définit la stratégie médicale de l’établissement et précise les mesures qui doivent être prises en application des dispositions du contrat pluriannuel mentionné aux articles L. 6114-1 et L. 6114-2. Il comprend notamment :

1° Les objectifs médicaux en cohérence avec le schéma régional ou interrégional de santé et le contenu de l’offre de soins ;

2° Les objectifs de l’établissement en matière d’amélioration de la qualité et de la sécurité des soins ;

3° Le cas échéant les objectifs en matière de recherche et de démarches innovantes ;

4° L’organisation des moyens médicaux ;

5° Une annexe spécifique précisant l’articulation entre les pôles d’activité pour garantir la cohérence du parcours de soins du patient ;

6° Un volet relatif à l’activité palliative des services ou unités fonctionnelles identifiant les services de l’établissement au sein desquels sont dispensés des soins palliatifs.
