Article D6213-5 of the French General Code of Local Authorities

I. – Part Four of the General Code of Territorial Authorities is applicable to Saint-Barthélemy under the conditions set out in this article.

II. – Book II is applicable to Saint-Barthélemy under the following conditions:

1° Titles I and III are not applicable to Saint-Barthélemy;

2° For the application of Article R. 4241-1, the economic, social and cultural council is assimilated to the regional economic, social and environmental council.

III. – Book IV is applicable to Saint-Barthélemy under the following conditions:

1° Titles I and II are not applicable to Saint-Barthélemy;

2° Articles R. 4431-1 to R. 4432-17 are not applicable to Saint-Barthélemy;

4° Articles R*. 4433-24 to R*. 4433-32 and R. 4433-33 to R. 4433-36 are not applicable to Saint-Barthélemy;

5° Articles R. 4434-1 and R. 4434-2 are not applicable to Saint-Barthélemy.

I. – La quatrième partie du code général des collectivités territoriales est applicable à Saint-Barthélemy dans les conditions prévues au présent article.

II. – Le livre II est applicable à Saint-Barthélemy dans les conditions suivantes :

1° Les titres Ier et III ne sont pas applicables à Saint-Barthélemy ;

2° Pour l’application de l’article R. 4241-1, le conseil économique, social et culturel est assimilé au conseil économique, social et environnemental régional.

III. – Le livre IV est applicable à Saint-Barthélemy dans les conditions suivantes :

1° Les titres Ier et II ne sont pas applicables à Saint-Barthélemy ;

2° Les articles R. 4431-1 à R. 4432-17 ne sont pas applicables à Saint-Barthélemy ;

4° Les articles R*. 4433-24 à R*. 4433-32 et R. 4433-33 à R. 4433-36 ne sont pas applicables à Saint-Barthélemy ;

5° Les articles R. 4434-1 et R. 4434-2 ne sont pas applicables à Saint-Barthélemy.
