Article D6221-37 of the French Public Health Code

The Minister for Health will decide on the application for authorisation after receiving the opinion of the committee referred to in article L. 6213-12. His decision is published in the Journal officiel de la République française.

The commission issues its opinion on the application for authorisation on the basis of a report drawn up by an expert chosen by the Minister for Health on the basis of his or her competence in the field of medical biology.

The expert analyses the laboratory’s application for authorisation in the light of criteria enabling verification that its operating conditions are equivalent to those imposed in article D. 6221-30 on medical biology laboratories established on French territory.

If the Minister for Health remains silent for more than four months from receipt of the application for authorisation, the application is deemed to have been rejected.

Le ministre chargé de la santé se prononce sur la demande d’autorisation après avis de la commission mentionnée à l’article L. 6213-12. Sa décision fait l’objet d’une publication au Journal officiel de la République française.

La commission émet son avis sur la demande d’autorisation au vu d’un rapport établi par un expert choisi par le ministre chargé de la santé en raison de sa compétence dans le domaine de la biologie médicale.

L’expert analyse la demande d’autorisation du laboratoire au regard de critères permettant de vérifier que ses conditions de fonctionnement sont équivalentes à celles imposées à l’article D. 6221-30 aux laboratoires de biologie médicale implantés sur le territoire français.

Le silence gardé par le ministre chargé de la santé pendant plus de quatre mois à compter réception de la demande d’autorisation vaut rejet de cette demande.
