Where it is established that the operating conditions of the laboratory holding the authorisation are not or are no longer equivalent to those imposed, under the first paragraph of Article 7 of Order no. 2010-49 of 13 January 2010 as amended relating to medical biology, on medical biology laboratories established on French territory, the authorisation shall be suspended or withdrawn by the Minister responsible for health.
However, the authorisation may only be suspended or withdrawn, except in the event of an immediate danger to public health, once the Minister for Health has informed the laboratory manager of the nature of the shortcomings observed and has given him formal notice to put an end to them within a specified period. A copy of the formal notice is sent to the competent authorities of the State in which the laboratory has its registered office. Reasons are given for the withdrawal or suspension of the authorisation. These decisions may concern only part of the authorisation.
