Article D6221-42 of the French Public Health Code

Where it is established that the operating conditions of the laboratory holding the authorisation are not or are no longer equivalent to those imposed, under the first paragraph of Article 7 of Order no. 2010-49 of 13 January 2010 as amended relating to medical biology, on medical biology laboratories established on French territory, the authorisation shall be suspended or withdrawn by the Minister responsible for health.

However, the authorisation may only be suspended or withdrawn, except in the event of an immediate danger to public health, once the Minister for Health has informed the laboratory manager of the nature of the shortcomings observed and has given him formal notice to put an end to them within a specified period. A copy of the formal notice is sent to the competent authorities of the State in which the laboratory has its registered office. Reasons are given for the withdrawal or suspension of the authorisation. These decisions may concern only part of the authorisation.

Lorsqu’il est établi que les conditions de fonctionnement du laboratoire titulaire de l’autorisation ne sont pas ou ne sont plus équivalentes à celles imposées, au titre du premier alinéa de l’article 7 de l’ordonnance n° 2010-49 du 13 janvier 2010 modifiée relative à la biologie médicale, aux laboratoires de biologie médicale implantés sur le territoire français, l’autorisation est suspendue ou retirée par le ministre chargé de la santé.

Toutefois, la suspension ou le retrait de l’autorisation, sauf en cas de danger immédiat pour la santé publique, ne peut intervenir que lorsque le ministre chargé de la santé a informé le responsable du laboratoire de la nature des manquements constatés et l’a mis en demeure de les faire cesser dans un délai déterminé. Une copie de la mise en demeure est adressée aux autorités compétentes de l’Etat dans lequel le siège social du laboratoire est établi. Le retrait ou la suspension de l’autorisation est motivé. Ces décisions peuvent ne concerner qu’une partie des éléments de l’autorisation.
