I.-When, in application of the provisions of the first paragraph of article L. 6222-4 and without prejudice to the application of the provisions of article D. 6222-6 relating to the opening of laboratories and their sites, the public health establishments of the Assistance publique-hôpitaux de Paris, the hospices civils de Lyon and the Assistance publique-hôpitaux de Marseille intend to operate more than one medical biology laboratory, the general director of the establishment must submit an application for authorisation to the general director of the regional health agency for the additional laboratory or laboratories, together with the application for authorisation provided for in the same article.
The application for authorisation is sent by the general manager of the establishment to the general manager of the regional health agency, together with a plan for the internal organisation of the establishment’s medical laboratories, including the number of medical laboratories envisaged, the number and geographical location of the sites of each medical laboratory and the list of hospitals using each medical laboratory.
II – Authorisation is granted by the Director General of the Regional Health Agency on condition that :
1° The internal organisation of the establishment with regard to medical biology laboratories, established in application of article L. 6143-7 by the general director of the establishment, justifies the maintenance or opening of more than one laboratory for the entire establishment;
2° The number of medical biology laboratories likely to be authorised in the establishment concerned does not exceed the number of its hospitals or hospital groupings;
3° The maintenance or opening of this or these laboratories does not have the effect of maintaining or increasing the supply of medical biology in the area in which the laboratories concerned are located to a level higher than that of the needs of the population as assessed by the regional health plan.
The reasoned decision of the Director General of the Regional Health Agency is notified within four months of receipt of the application, provided that it is complete within the meaning of Article D. 6222-6.
