Article D6222-11 of the French Public Health Code

I.-When, in application of the provisions of the first paragraph of article L. 6222-4 and without prejudice to the application of the provisions of article D. 6222-6 relating to the opening of laboratories and their sites, the public health establishments of the Assistance publique-hôpitaux de Paris, the hospices civils de Lyon and the Assistance publique-hôpitaux de Marseille intend to operate more than one medical biology laboratory, the general director of the establishment must submit an application for authorisation to the general director of the regional health agency for the additional laboratory or laboratories, together with the application for authorisation provided for in the same article.

The application for authorisation is sent by the general manager of the establishment to the general manager of the regional health agency, together with a plan for the internal organisation of the establishment’s medical laboratories, including the number of medical laboratories envisaged, the number and geographical location of the sites of each medical laboratory and the list of hospitals using each medical laboratory.

II – Authorisation is granted by the Director General of the Regional Health Agency on condition that :

1° The internal organisation of the establishment with regard to medical biology laboratories, established in application of article L. 6143-7 by the general director of the establishment, justifies the maintenance or opening of more than one laboratory for the entire establishment;

2° The number of medical biology laboratories likely to be authorised in the establishment concerned does not exceed the number of its hospitals or hospital groupings;

3° The maintenance or opening of this or these laboratories does not have the effect of maintaining or increasing the supply of medical biology in the area in which the laboratories concerned are located to a level higher than that of the needs of the population as assessed by the regional health plan.

The reasoned decision of the Director General of the Regional Health Agency is notified within four months of receipt of the application, provided that it is complete within the meaning of Article D. 6222-6.

Article D6222-11

I.-Lorsque, en application des dispositions du premier alinéa de l’article L. 6222-4 et sans préjudice de l’application des dispositions de l’article D. 6222-6 relatives à l’ouverture des laboratoires et de leurs sites, les établissements publics de santé de l’Assistance publique-hôpitaux de Paris, des hospices civils de Lyon et de l’Assistance publique-hôpitaux de Marseille entendent gérer plus d’un laboratoire de biologie médicale, le directeur général de l’établissement joint au dossier de déclaration d’ouverture prévu au même article une demande d’autorisation au directeur général de l’agence régionale de santé pour le ou les laboratoires de biologie en surnombre.

La demande d’autorisation est adressée par le directeur général de l’établissement au directeur général de l’agence régionale de santé, accompagnée du projet d’organisation interne des laboratoires de biologie médicale de l’établissement comportant le nombre de laboratoires de biologie médicale envisagé, le nombre et l’implantation géographique des sites de chaque laboratoire de biologie médicale ainsi que la liste des hôpitaux qui recourent à chaque laboratoire de biologie médicale.

II.-L’autorisation est accordée par le directeur général de l’agence régionale de santé sous réserve que :

1° L’organisation interne de l’établissement en ce qui concerne les laboratoires de biologie médicale, arrêtée en application de l’article L. 6143-7 par le directeur général de l’établissement, justifie le maintien ou l’ouverture de plus d’un laboratoire pour l’ensemble de l’établissement ;

2° Le nombre de laboratoires de biologie médicale susceptibles d’être autorisés dans l’établissement concerné ne soit pas supérieur au nombre de ses hôpitaux ou groupements hospitaliers ;

3° Le maintien ou l’ouverture de ce ou ces laboratoires n’a pas pour effet de maintenir ou de porter l’offre de biologie médicale dans la zone d’implantation des laboratoires concernés à un niveau supérieur à celui des besoins de la population tels qu’appréciés par le schéma régional de santé.

La décision motivée du directeur général de l’agence régionale de santé est notifiée dans un délai de quatre mois à compter de la réception de la demande dès lors qu’elle est complète au sens de l’article D. 6222-6.
