Article D6361-6 of the French General Code of Local Authorities

The articles of the budgets voted by function correspond:

a) Investment section:

– for expenditure and revenue that can be broken down, to groups 90 “Departmental facilities” or 91 “Non-Departmental facilities”, completed by the most detailed subdivision of the functional nomenclature set by joint order of the Minister in charge of the budget and the Minister in charge of Overseas France, as well as the number of the programme in the case of voting by programme. The programme corresponds to a set of acquisitions of fixed assets, work on fixed assets and related study costs, leading to the completion of a work or several works of the same nature;

– for non-breakdownable expenditure and revenue, to each of the non-breakdownable chapters, the list and composition of which are set by the order provided for in Article D. 6261-7, supplemented by the most detailed subdivision of the nomenclature by nature set by joint order of the Minister for the Budget and the Minister for Overseas France.

The chapters relating to transactions on behalf of third parties as well as the chapters corresponding to unforeseen expenditure, the transfer from the operating section and proceeds from the disposal of fixed assets do not include an article.

b) Operating section:

– for expenditure and revenue that can be broken down, to group 93 “Breakdown of operations”, supplemented by the most detailed subdivision of the functional nomenclature set by joint order of the Minister responsible for the budget and the Minister responsible for overseas departments and territories;

– for expenditure and revenue that cannot be broken down, to the chapter number, supplemented by the most detailed account of the nomenclature by nature, set by order of the Minister responsible for the budget and the Minister responsible for overseas departments and territories.

The chapters relating to unforeseen expenditure and the transfer to the investment section do not include an article.

– pour les dépenses et recettes ventilables, aux groupes 90 ” Equipements départementaux ” ou 91 ” Equipements non départementaux “, complétés par la subdivision la plus détaillée de la nomenclature fonctionnelle fixée par arrêté conjoint du ministre chargé du budget et du ministre chargé de l’outre-mer, ainsi que du numéro du programme en cas de vote par programme. Le programme correspond à un ensemble d’acquisitions d’immobilisations, de travaux sur immobilisations et de frais d’études y afférents, aboutissant à la réalisation d’un ouvrage ou de plusieurs ouvrages de même nature ;

– pour les dépenses et recettes non ventilables, à chacun des chapitres non ventilés, dont la liste et la composition sont fixées par l’arrêté prévu à l’article D. 6261-7, complété par la subdivision la plus détaillée de la nomenclature par nature fixée par arrêté conjoint du ministre chargé du budget et du ministre chargé de l’outre-mer.

Les chapitres relatifs aux opérations pour compte de tiers ainsi que les chapitres correspondant aux dépenses imprévues, au virement de la section de fonctionnement et aux produits des cessions d’immobilisations ne comportent pas d’article.

b) Section de fonctionnement :

– pour les dépenses et recettes ventilables, au groupe 93 ” Opérations ventilées “, complété par la subdivision la plus détaillée de la nomenclature fonctionnelle fixée par arrêté conjoint du ministre chargé du budget et du ministre chargé de l’outre-mer ;

– pour les dépenses et recettes non ventilables, au numéro du chapitre, complété du compte le plus détaillé de la nomenclature par nature, fixée par un arrêté du ministre chargé du budget et du ministre chargé de l’outre-mer.

Les chapitres relatifs aux dépenses imprévues et au virement à la section d’investissement ne comportent pas d’article.
