Article D6431-55 of the French Public Health Code

When the total cost of a works project exceeds a threshold set by order of the Ministers for the Budget, Overseas Territories and Health, the Board of Directors decides on the basis of a file containing the following information for the project in question:

1° A presentation report placing the operation in the context of the hospital project and justifying, where appropriate, any changes in relation to this project;

2° A technical file, the content of which is defined by order of the Minister for Health;

3° A study of the costs incurred by the operation in terms of both operation and investment;

4° The financing plan for the operation as part of the establishment’s revised multi-year overall financing plan.

Lorsqu’une opération de travaux présente un coût total supérieur à un seuil fixé par arrêté des ministres chargés du budget, de l’outre-mer et de la santé, le conseil d’administration délibère sur la base d’un dossier comprenant pour cette opération :

1° Un rapport de présentation replaçant l’opération dans le contexte du projet hospitalier et justifiant, le cas échéant, toute évolution par rapport à celui-ci ;

2° Un dossier technique dont le contenu est défini par arrêté du ministre chargé de la santé ;

3° Une étude sur les coûts induits par l’opération tant en matière d’exploitation que d’investissement ;

4° Le plan de financement de l’opération intégré dans le plan global de financement pluriannuel révisé de l’établissement.
