Article D712-30 of the French Intellectual Property Code

The alert is sent by the National Institute of Industrial Property electronically within five working days of the publication of the filing of an application for registration of the trademark, containing the name of the community or the name of the country concerned, in the Official Bulletin of Industrial Property.

Where the trade mark application is filed pursuant to Regulation (EU) 2017/1001 of 14 June 2017 on the European Union trade mark or the Madrid Agreement concerning the International Registration of Marks of 14 April 1891, as amended, and its Protocol of 27 June 1989, as amended, the Institute shall send the alert electronically within three weeks of publication of the trade mark application in the Bulletin of Trade Marks of the European Union or the Gazette of International Marks.

The alert mentions the opportunity open to any interested person to make observations under Article L. 712-3 and to local authorities to oppose registration under articles L. 712-4 and L. 712-4-1.

L’alerte est adressée par l’Institut national de la propriété industrielle par voie électronique dans les cinq jours ouvrables suivant la publication du dépôt d’une demande d’enregistrement de la marque, contenant la dénomination de la collectivité ou le nom de pays concerné, au Bulletin officiel de la propriété industrielle.

Lorsque le dépôt de marque est effectué en application du règlement (UE) 2017/1001 du 14 juin 2017 sur la marque de l’Union européenne ou de l’arrangement de Madrid concernant l’enregistrement international des marques du 14 avril 1891 modifié et de son protocole du 27 juin 1989 modifié, l’institut adresse l’alerte par voie électronique dans les trois semaines qui suivent la publication de la demande de marque au Bulletin des marques de l’Union européenne ou à la Gazette des marques internationales.

L’alerte mentionne la faculté ouverte à toute personne intéressée de formuler des observations au titre de l’article L. 712-3 et aux collectivités territoriales de former opposition à enregistrement au titre des articles L. 712-4 et L. 712-4-1.
