The alert is sent by the National Institute of Industrial Property electronically within five working days of the publication of the filing of an application for registration of the trademark, containing the name of the community or the name of the country concerned, in the Official Bulletin of Industrial Property.
Where the trade mark application is filed pursuant to Regulation (EU) 2017/1001 of 14 June 2017 on the European Union trade mark or the Madrid Agreement concerning the International Registration of Marks of 14 April 1891, as amended, and its Protocol of 27 June 1989, as amended, the Institute shall send the alert electronically within three weeks of publication of the trade mark application in the Bulletin of Trade Marks of the European Union or the Gazette of International Marks.
The alert mentions the opportunity open to any interested person to make observations under Article L. 712-3 and to local authorities to oppose registration under articles L. 712-4 and L. 712-4-1.
