Article D754-2 of the French Monetary and Financial Code

I. – Are applicable in the Wallis and Futuna Islands, subject to the adaptations provided for in II, the provisions of the articles mentioned in the left-hand column of the table below, in the wording indicated in the right-hand column of the same table:

II. – For the application of I:
1° In article D. 312-1-1:
a) In 7° of A of I, the words: “in euros in the euro zone” are replaced by the words: “in CFP francs” and the words: “in euros with a card” are replaced by the words: “in CFP francs with a card”;
b) In 9°, 10° and 11° of A of I, the occurrences of the word : “SEPA” are replaced by the words: “local or SEPA COM Pacific”;
c) 1° and 2° of b of B of I are replaced by the following provisions:
“1° Issuing an international credit transfer : the account is debited with the amount of a transfer, whether permanent or occasional, denominated in a foreign currency or in euros outside France;
“2° Issuing a SEPA-COM-Pacific transfer (in the case of a permanent SEPA-COM-Pacific transfer): the account is debited with the amount of a permanent SEPA-COM-Pacific credit transfer denominated in euros to a beneficiary whose account is located in mainland France, New Caledonia or French Polynesia;
“2° bis Issuing a local credit transfer (in the case of a permanent local credit transfer): the account is debited with the amount of a permanent local transfer denominated in CFP francs, for the benefit of a beneficiary whose account is located in the Wallis and Futuna Islands;”
2° In Article D. 312-5, 7° is replaced by the following provisions:
“7° Payments by local or SEPA-COM-Pacific direct debit, local or SEPA-COM-Pacific interbank payment instrument or by local or SEPA-COM-Pacific bank transfer, which may be made over the counter or remotely”;
3° In Articles D. 312-5 and D. 312-5-1, all occurrences of the words: “in the European Union” are replaced by the words: “in France”.

I. – Sont applicables dans les îles Wallis et Futuna, sous réserve des adaptations prévues au II, les dispositions des articles mentionnés dans la colonne de gauche du tableau ci-après, dans leur rédaction indiquée dans la colonne de droite du même tableau :

II. – Pour l’application du I :
1° A l’article D. 312-1-1 :

b) Au 9°, au 10° et au 11° du A du I, les occurrences du mot : « SEPA » sont remplacées par les mots : « local ou SEPA COM Pacifique » ;
c) Le 1° et le 2° du b du B du I sont remplacés par les dispositions suivantes :
« 1° Emission d’un virement international : le compte est débité du montant d’un virement, permanent ou occasionnel, libellé en devises ou en euros en dehors de la France ;
« 2° Emission d’un virement SEPA-COM-Pacifique (cas d’un virement SEPA-COM-Pacifique permanent) : le compte est débité du montant d’un virement SEPA-COM-Pacifique permanent libellé en euros au profit d’un bénéficiaire dont le compte est situé en France métropolitaine, en Nouvelle-Calédonie ou en Polynésie française ;
« 2° bis Emission d’un virement local (cas d’un virement local permanent) : le compte est débité du montant d’un virement local permanent libellé en francs CFP, au profit d’un bénéficiaire dont le compte est situé dans les îles Wallis et Futuna ; »
2° A l’article D. 312-5, le 7° est remplacé par les dispositions suivantes :
« 7° Les paiements par prélèvements locaux ou SEPA-COM-Pacifique, titre interbancaire de paiement local ou SEPA-COM-Pacifique ou par virement bancaire local ou SEPA-COM-Pacifique, ce dernier pouvant être réalisé aux guichets ou à distance » ;
3° Aux articles D. 312-5 et D. 312-5-1, toutes les occurrences des mots : « dans l’Union européenne » sont remplacées par les mots : « en France ».
