Article D762-13 of the French Monetary and Financial Code

I. – Subject to the adaptations provided for in II, the provisions of the articles mentioned in the left-hand column of the table below shall apply in New Caledonia, in the wording indicated in the right-hand column of the same table:

II. – For the application of I:
1° In article D. 452-2:
a) The words: “within the meaning of article 5 of the law of 1st July 1901” are deleted;
b) The words: “by Book VI of the Commercial Code or, under the previous system, by article 108 of law no. 67-563 of 13th July 1967 on judicial settlement, liquidation of assets, personal bankruptcy and bankruptcies, for the duration of the latter” are replaced by the words: “locally with the same effect”;
2° In article D. 452-5, the words: “to the departmental directorate for competition, consumer affairs and fraud control” are replaced by the words: “to the locally competent service with the same purpose”.

Article D762-13

I. – Sont applicables en Nouvelle-Calédonie, sous réserve des adaptations prévues au II, les dispositions des articles mentionnés dans la colonne de gauche du tableau ci-après, dans leur rédaction indiquée dans la colonne de droite du même tableau :

II. – Pour l’application du I :
1° A l’article D. 452-2 :
a) Les mots : « au sens de l’article 5 de la loi du 1er juillet 1901 » sont supprimés ;
b) Les mots : « par le livre VI du code de commerce ou, dans le régime antérieur, à l’article 108 de la loi n° 67-563 du 13 juillet 1967 sur le règlement judiciaire, la liquidation des biens, la faillite personnelle et les banqueroutes, pendant la durée de celle-ci » sont remplacés par les mots : « localement ayant le même effet » ;
2° A l’article D. 452-5, les mots : « à la direction départementale de la concurrence, de la consommation et de la répression des fraudes », sont remplacés par les mots : « au service compétent localement ayant le même objet ».
