Article D8121-2 of the French Labour Code

Any member of staff involved in labour inspection activities may refer to the National Labour Inspection Council any action taken by an administrative authority that may directly and personally affect the conditions under which he/she must be able to carry out his/her duties.

The Council decides whether the complaint is admissible. If it is admissible, it will investigate the case, inform the central authority, which will submit its observations if it considers this useful, and issue a reasoned opinion which will be sent to the Minister for Labour and, where applicable, to the minister to whom the employee reports, and notified to the employee.

The opinion is simultaneously sent to the central authority and to the joint administrative commission of the interministerial body to which the employee belongs.

Le Conseil national de l’inspection du travail peut être saisi par tout agent participant aux activités de contrôle de l’inspection du travail de tout acte d’une autorité administrative de nature à porter directement et personnellement atteinte aux conditions dans lesquelles il doit pouvoir exercer sa mission.

Le conseil se prononce sur la recevabilité de la saisine. Dans le cas où elle est recevable, il procède à l’instruction du dossier, informe l’autorité centrale, qui présente ses observations si elle le juge utile et rend un avis motivé transmis au ministre chargé du travail et, le cas échéant, au ministre dont relève l’agent et notifié à l’agent.

L’avis est simultanément adressé à l’autorité centrale et à la commission administrative paritaire du corps interministériel dont relève l’agent.
