Everyone has the right to receive treatment and care aimed at relieving their suffering. In all circumstances, this suffering must be prevented, taken into account, assessed and treated.
The doctor must use all analgesic and sedative treatments to respond to the refractory suffering of the patient in an advanced or terminal phase, even if they may have the effect of shortening life. He must inform the patient of this, without prejudice to the fourth paragraph of article L. 1111-2, the trusted support person provided for in article L. 1111-6, the family or, failing this, one of the patient’s relatives. The procedure followed is recorded in the medical record.
Any person is informed by healthcare professionals of the possibility of being cared for at home, as soon as their condition allows.
