Article L1111-16 of the French Public Health Code

The coordinating doctor referred to in V of article L. 313-12 of the Social Action and Family Code has access to the shared medical record of the person accommodated in the institution subject to the agreement of the latter or, if the person accommodated is an adult subject to a legal protection measure with representation relating to the person and is not capable of expressing his or her wishes, of the person in charge of this measure, who takes into account the opinion of the protected person.

The attending doctor referred to in article L. 162-5-3 of the Social Security Code has a right of access to the shared medical record, allowing him/her to access, by way of derogation from the last paragraph of article L. 1111-15 of the present code, all the information contained in this record.

Le médecin coordonnateur mentionné au V de l’article L. 313-12 du code de l’action sociale et des familles a accès au dossier médical partagé de la personne hébergée dans l’établissement sous réserve de l’accord de celle-ci ou, si la personne hébergée est un majeur faisant l’objet d’une mesure de protection juridique avec représentation relative à la personne et n’est pas apte à exprimer sa volonté, de la personne chargée de cette mesure, qui tient compte de l’avis de la personne protégée.

Le médecin traitant mentionné à l’article L. 162-5-3 du code de la sécurité sociale dispose d’un droit d’accès au dossier médical partagé lui permettant d’accéder, par dérogation au dernier alinéa de l’article L. 1111-15 du présent code, à l’ensemble des informations contenues dans ce dossier.
