Article L1114-3 of the French Public Health Code

Employees who are members of an association referred to in article L. 1114-1 are entitled to the representation leave provided for by L. 3142-51 of the Labour Code when they are called upon to sit on :

1° Either on the supervisory board, or on the body authorised for this purpose, of a public or private health establishment, or on the statutory commissions and bodies of the said establishment;

2° Or in the regional or national consultative bodies and national public establishments provided for in this code.

The allowance referred to inarticle L. 3142-52 of the Labour Code is paid by the public or private health institution concerned in the case referred to in 1° of this article; in the cases referred to in 2°, it is paid by the institutions concerned, or by the State in the case of bodies set up by the State.

Article L1114-3

Les salariés, membres d’une association visée à l’article L. 1114-1, bénéficient du congé de représentation prévu par L. 3142-51 du code du travail lorsqu’ils sont appelés à siéger :

1° Soit au conseil de surveillance, ou à l’instance habilitée à cet effet, d’un établissement de santé public ou privé, ou aux commissions et instances statutaires dudit établissement ;

2° Soit dans les instances consultatives régionales ou nationales et les établissements publics nationaux prévus par le présent code.

L’indemnité mentionnée à l’article L. 3142-52 du code du travail est versée par l’établissement de santé public ou privé concerné dans le cas visé au 1° du présent article ; dans les cas visés au 2°, elle est versée par les établissements concernés, ou par l’Etat lorsqu’il s’agit d’instances instituées auprès de l’Etat.
