Article L1121-14 of the French Public Health Code

No research may be carried out on a deceased person in a state of brain death without their consent expressed during their lifetime or through the testimony of their family.

However, if the deceased person is a minor, this consent must be expressed by each of the holders of parental authority. If it is impossible to consult one of the holders of parental authority, the research may be carried out provided that the other holder consents.

The provisions of article 225-17 of the French Criminal Code do not apply to such research.

Aucune recherche ne peut être effectuée sur une personne décédée, en état de mort cérébrale, sans son consentement exprimé de son vivant ou par le témoignage de sa famille.

Toutefois, lorsque la personne décédée est un mineur, ce consentement est exprimé par chacun des titulaires de l’autorité parentale. En cas d’impossibilité de consulter l’un des titulaires de l’autorité parentale, la recherche peut être effectuée à condition que l’autre titulaire y consente.

Les dispositions de l’article 225-17 du code pénal ne sont pas applicables à ces recherches.
