No research mentioned in 1° of Article L. 1121-1 may be carried out on a person without their free and informed consent, obtained in writing, after they have been given the information provided for in Article L. 1122-1. Where it is impossible for the person concerned to express their consent in writing, it may be attested by the trusted support person provided for in Article L. 1111-6, by a family member or, failing this, by one of the close relatives of the person concerned, provided that this trusted support person, family member or relative is independent of the investigator and the sponsor.

No research mentioned in 3° of the same article L. 1121-1 may be carried out on a person if he/she has opposed it.
In the event that the person undergoing research has withdrawn their consent, this withdrawal has no impact on the activities carried out and on the use of data obtained on the basis of the informed consent expressed before it was withdrawn.
