In the case of research involving the human person to be carried out in emergency situations where it is not possible to obtain the prior consent of the person who will be subjected to the research, where such consent is required, the protocol submitted for the opinion of the committee referred to in Article L. 1123-1 may stipulate that the consent of this person is not sought and that only the consent of the members of his family or that of the trusted support person referred to in Article L. 1111-6 is sought under the conditions set out in Article L. 1122-1-1, if they are present. The protocol may provide for a derogation from this obligation in the event of an immediate life-threatening emergency, which is assessed by this committee. The person concerned or, where applicable, family members or the trusted support person referred to in article L. 1111-6 are informed as soon as possible and their consent, where required, is sought for any continuation of this research. They may also object to the use of data concerning the person in the context of this research.
