Article L1123-17 of the French Public Health Code

When the authority designated in article L. 1123-12 or in II of articles L. 1125-1 and L. 1126-1 does not have agents with the level of clearance required for national defence confidentiality, given the level of classification of the research involving the human person, the clinical investigation or the performance study that is envisaged, the competent authority, within the meaning of this article, is the Prime Minister.

Article L1123-17

Lorsque l’autorité désignée à l’article L. 1123-12 ou au II des articles L. 1125-1 et L. 1126-1 ne dispose pas d’agents possédant le niveau d’habilitation requis au titre du secret de la défense nationale compte tenu du niveau de classification de la recherche impliquant la personne humaine, de l’investigation clinique ou de l’étude des performances qui est envisagée, l’autorité compétente, au sens de cet article, est le Premier ministre.
