Article L1123-18 of the French Public Health Code

Any substantial modification at the initiative of the sponsor of a research project, clinical investigation or performance study covered by national defence confidentiality must obtain, prior to its implementation, a favourable opinion from the Defence and National Security Committee for the Protection of Individuals mentioned in I of Article L. 1123-16 and, in the case of research mentioned in 1° of article L. 1121-1, clinical investigations mentioned in II of article L. 1125-1, or performance studies mentioned in II of article L. 1126-1, authorisation from the competent authority. In this case, the Committee ensures that a new consent is obtained from the persons participating in the research, clinical investigation or performance study.

Article L1123-18

Toute modification substantielle à l’initiative du promoteur d’une recherche, d’une investigation clinique ou d’une étude des performances relevant du secret de la défense nationale doit obtenir, préalablement à sa mise en œuvre, un avis favorable du comité de protection des personnes-défense et sécurité nationale mentionné au I de l’article L. 1123-16 et, dans le cas de recherches mentionnées au 1° de l’article L. 1121-1, d’investigations cliniques mentionnées au II de l’article L. 1125-1, ou d’études des performances mentionnées au II de l’article L. 1126-1, une autorisation de l’autorité compétente. Dans ce cas, le comité s’assure qu’un nouveau consentement des personnes participant à la recherche, à l’investigation clinique ou à l’étude des performances est recueilli.
