Article L1125-23 of the French Public Health Code

The following is punishable by one year’s imprisonment and a fine of 15,000 euros:

1° Without having obtained the favourable opinion of a personal protection committee and, in the case of clinical investigations mentioned in the second and third paragraphs of II of Article L. 1125-1, the authorisation of the competent authority;

2° Under conditions contrary to the provisions of article L. 1125-11;

3° The performance of which has been prohibited or suspended by the competent authority.

Any investigator who carries out such a clinical investigation in breach of the provisions of article L. 1125-12 shall be liable to the same penalties.

Article L1125-23

Est puni d’un an d’emprisonnement et de 15 000 euros d’amende le fait de pratiquer ou de faire pratiquer une investigation clinique :


1° Sans avoir obtenu l’avis favorable d’un comité de protection des personnes et, dans les cas d’investigations cliniques mentionnées aux deuxième et troisième alinéas du II de l’article L. 1125-1, l’autorisation de l’autorité compétente ;


2° Dans des conditions contraires aux dispositions de l’article L. 1125-11 ;


3° Dont la réalisation a été interdite ou suspendue par l’autorité compétente.


L’investigateur qui réalise une telle investigation clinique en méconnaissance des dispositions de l’article L. 1125-12 est puni des mêmes peines.
