Dans le cadre d’une investigation clinique comportant une intervention non justifiée par sa prise en charge habituelle et lui faisant encourir des risques et des contraintes non minimes, le fait pour le promoteur de ne pas fournir gratuitement aux investigateurs, pendant la durée de l’investigation clinique, les dispositifs médicaux faisant l’objet de l’investigation clinique est puni de 30 000 euros d’amende.
